Your contract is with Triton Holidays Ltd.
The Triton Conference is acting as an agent on behalf of Triton Holidays Ltd.
1. Your conference package contract
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms and conditions. A contract will exist as soon as we issue our confirmation invoice. The Triton Conference is acting as an agent on behalf of the hotels concerned and your contract for your accommodation is made with the hotel. This contract is made on the terms of these booking conditions, which are governed by English law, and the jurisdiction of the English courts. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so.
2. Your financial protection
The Triton Conference is working as an agent of Triton Holidays Ltd that hold ATOL no 3973 issued by the Civil Aviation Authority, which provides for your protection in the event of insolvency.
3. Your conference package price
When you make a booking on-line you have entered into a contract with Triton Holidays and are bound to pay the full price of your registration and accommodation arrangements. You may request an invoice to make payment via bank transfer, in which case payment must be received within 30 days from the date of invoice. If payment is not received, this will result in the cancellation of your booking.
4. If you change your booking
If, after our confirmation invoice has been issued, you wish to change your accommodation arrangements in any way, for example your chosen departure date or hotel, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You will be asked to pay an administration charge of £15 per person per change plus any applicable charge by a supplier, and any further cost we incur in making this alteration.
5. If you cancel your conference package
You, or any member of your party, may cancel your package arrangements at any time. Written notification from the person who made the booking must be received at our offices. Registration fees are non-transferable and non-refundable.
Since we incur costs in cancelling your accommodation arrangements, you will have to pay the applicable cancellation charges up to the maximum shown below. Note: if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
Cancellation of your accommodation will attract the following cancellation charges:
• Between 3 months and 1 Months before the 18th April, 2008, (18th January 2008 18th March 2008) 75% of the total of the room cost will be charged.
• Between 1 Month and the arrival day (18th March 2008 – 18th April 2008), 100% of the total of the room cost will be charged.
• No Shows: In the case of no-shows a charge of the full amount corresponding to guest rooms and breakfast for all of the days reserved.
6. If we change or cancel your conference package
It is unlikely that we will have to make any changes to your conference package arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you of them at the earliest possible date. If we do make a minor change, you are not entitled to cancel your conference package (without paying the cancellation charges shown above) and we will not pay compensation.
We also reserve the right in any circumstances to cancel your accommodation arrangements. However, we will not cancel your accommodation arrangements less than 8 weeks before your departure date, except for reasons of force majeure, failure by you to pay the final balance or if the conference is cancelled. If we cancel your accommodation arrangements, you can either have a refund of all monies paid or accept an offer of alternative accommodation arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value).
If we make a major change to your conference package, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting the change of arrangements, or cancelling your booked conference package and receiving a full refund of all accommodation monies paid. In all cases of a major change or cancellation by us, except where the change or cancellation arises for reasons of force majeure, or change of venue, change of date of the conference or the cancellation of the conference, we will pay compensation.
Force majeure: we will not pay you compensation if we have to cancel or change your accommodation arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics or advice from the foreign office or a world health organisation recommendation against travel to a destination or restrictions upon such travel.
7. If you have a complaint
If you have a problem during the conference you must immediately inform the relevant supplier (e.g. your hotelier or the Triton Conference Registration desk at the Pueblo Espanol and a representative will endeavour to put things right. If you fail to follow this procedure we will have been deprived of the opportunity to investigate and rectify your complaint and this may affect your rights under this contract. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to the Triton Conference Office, 5 Millers House, Roydon Road, Stanstead Abbots, Hertfordshire, SG12 8HN giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint during the conference and this may affect your rights under this contract.
9. Our liability to you
If the contract we have with you is not performed or is improperly performed by us or our suppliers we will pay you appropriate compensation if this has affected the enjoyment of your accommodation arrangements. However we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the accommodation arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.
Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of twice the times of the cost of your package arrangements.
10. Personal injury unconnected with your booked package arrangements
If you, or any member of your party, suffer death, illness or injury whilst overseas arising out of an activity which does not form part of your conference arrangements, we shall at our discretion, offer advice, guidance and assistance. Where legal action is contemplated whilst you are overseas and you want our assistance, you must obtain our written consent prior to commencement of proceedings. Our consent will be given subject to you undertaking to refund any costs we incur on your behalf and to assign any costs, benefits received under any relevant insurance policy to ourselves. We limit the aggregate amount of our assistance to you and any member of your party to £5,000 per booking.
11. Late booking fees
Delegates making bookings within 4 weeks of travel (i.e 21 March – 18 April) will be charged a late booking fee of £20.00 per person.
